Terms and Conditions

Please read the following terms and conditions before completing your booking as these and the Booking Form are the basis of the contract between you and Uniquely Scotland.

Please note that all holidays are subject to availability.

1. Definitions and Interpretation

In these terms and conditions:

Uniquely Scotland are a partnership having registered its office at Kippenrait East, Sheriffmuir, Dunblane, Perthshire, FK15 0LP. In the text “we”, “us” and “our” shall refer to Uniquely Scotland.

“You” refers to the person engaging Uniquely Scotland to provide a service. “Service” refers to any holiday booking and advice service provided by us and/or its nominated sub-contractors and suppliers.

All bookings must be made by a person who is 18 years of age or older. The person who makes the booking or represents themselves as making the booking will be responsible for full payment to us for the price of the holiday and will be deemed to have the agreement of all the other members of the party to these conditions.

Your contract is made on the terms of these booking conditions which are governed by Scottish law.

2. Packages

For UK Operators selling Packages in the UK only

In accordance with the UK Package Travel & Linked Travel Regulations 2018 all passengers booking with Uniquely Scotland are fully protected for the initial deposit and subsequently the balance of all monies received by us, including repatriation costs and arrangements, arising from cancellation or curtailment of your travel arrangements due to the insolvency of Uniquely Scotland

There is no requirement for Financial Protection of day trips or single elements, and none is provided. 

Uniquely Scotland has taken out an insurance provided by International Passenger Protection Ltd (IPP) with Liberty Mutual Insurance Europe SE (LMIE) trading as Liberty Specialty Markets, a member of the Liberty Mutual Insurance Group. LMIE's registered office: 5-7 rue Leon Laval, L-3372, Leudelange, Grand Duchy of Luxembourg, Registered Number B232280 (Registre de Commerce et des Sociétés).  LMIE is a European public limited liability company and is supervised by the Commissariat aux Assurances and licensed by the Luxembourg Minister of Finance as an insurance and reinsurance company. This insurance is only valid for passengers who book and pay directly with/to Uniquely Scotland

Claims

In the unlikely event of Insolvency, you must Inform International Passenger Protection Ltd immediately.

In order to deal promptly with any claim hereunder it is essential that you retain all bills, receipts and other documents relating to your travel arrangements.

3. Deposit and Payment

To secure your booking we will require a 20% non-refundable deposit payable by credit card, debit card, cheque or bank transfer but we will not be obliged to treat your payment as made until we are in clear funds. The full balance of payment is due 8 weeks before your holiday start date to allow us to pay our suppliers. If the holiday booking is done within 8 weeks of your proposed holiday start date, we will require payment in full.

If paying by bank transfer, please ensure any charges your bank adds on for sending and receiving are paid before sending payment

The person who makes the booking or represents themselves as making the booking is responsible for full payment to us for the price of the holiday (including any insurance premiums and cancellation charges) and warrants that they are properly empowered to enter into a contract on behalf of, and with the consent of, all persons for whom the booking is completed.

4. Service Changes

Uniquely Scotland has the right to make individual changes to the contracted services on justified grounds due to significant and unforeseeable circumstances, provided such changes are insubstantial, do not affect the overall structure of the tour and became necessary after conclusion of the contract.

Uniquely Scotland is required to notify the client of any changes without delay. In the event of significant changes to the contracted services, the client has the right to cancel the proposed holiday without charge or demand another tour of equal value, provided that Uniquely Scotland has such a tour in its selection that can be offered without additional cost to the client. The client must exercise such rights at least within a 14 day period after Uniquely Scotland explanation of the service changes.

5. Cancellation by Client

In the event of you cancelling your holiday for whatever reason, the deposit will be retained. If you or any member of the party wish to cancel a confirmed booking we require the person who made the booking to send to us written confirmation.

Should you wish to cancel your holiday after your booking has been accepted by us, then we will impose the following charges which depends on how much notice is given before the commencement of the holiday itself:

  • More than 56 days prior to commencement of the holiday: the deposit;
  • 56 - 28 days prior to commencement of the holiday: 30% of holiday cost;
  • 28 - 13 days prior to commencement of the holiday: 60% of holiday cost;
  • Less than 13 days prior to commencement of the holiday: 100% of holiday cost.

If transport tickets have been issued at the time of cancellation 100% cancellation fees will apply to this element.

6. Cancellation by Uniquely Scotland

We will do our utmost to deliver the holiday which we have contracted to provide you. However, in the unlikely event of us having to cancel any part of your holiday due to circumstances beyond our control, we will either provide you with a suitable replacement at no extra charge, or a refund if that cannot be agreed.

7. Alterations to your Itinerary

We advise you to carefully check the proposed itinerary we provide.  Should you later wish to change any aspects of your tour when we have already made accommodation bookings on your behalf, additional administration charges will apply.

8. Insurance

We strongly recommend that you take out full insurance covering risks such as cancellation and delay. Please also ensure that you are adequately insured in case of illness abroad. We advise that you check your insurance policy to ensure that it covers all activities booked. It is your responsibility to ensure that you are adequately insured for the holiday, as we will not check your policy. It is important that you and your party are covered under the terms of your own travel insurance.

All attractions/transport and experiences not operated by Uniquely Scotland will be subject to the normal conditions of the individual operator.

9. Activities

If an activity has been booked as part of your package, we will send you details of any terms and conditions that apply and it will be your responsibility to ensure that you and each member of your party adhere to such terms and conditions.

It will be your responsibility to inform us immediately on receipt of such specific terms and conditions if you or any member of your party will be unable to comply with any such terms and conditions. Please note that you and your party may be required to sign a disclaimer form prior to commencing any activity.

10. Medical Conditions

You are responsible for ensuring that we are advised of any existing medical conditions or disabilities which may require assistance before you book your holiday or, if newly diagnosed, before the date your holiday starts so that we can pass these details on to our suppliers in good time. We will not be liable if any carrier refuses to accept you or any member of your party as a passenger as a result of any medical condition or disability.

11. Car Rentals

If you are renting a vehicle through Uniquely Scotland please read your personal travel insurance first, to see what is included in your own insurance. 

Please note that if clients decide to book their car hire through Arnold Clark, Europcar or Enterprise via Uniquely Scotland, UK clients will require their current driving licence with paper counterpart. Overseas clients will require their current driving licence with passport. All parties will require the payment card that they used to pay for the rental when they booked.

12. Complaints

Whilst Uniquely Scotland will do everything we can to provide you with a trouble free and enjoyable holiday, we understand that occasionally things can go wrong. Any complaints must first be notified to the supplier of the services concerned and no later than 48 hours of the basis for complaint arising. If you are still dissatisfied, you must then notify Uniquely Scotland at the earliest opportunity and write to us within 7 days of returning from your holiday to the address as shown in the “Contact Us” section below. Following on from this we will do what we can to resolve your disputes. Except in relation to claims which involve personal injury, illness or death, Uniquely Scotland cannot accept any liability if you fail to notify the complaint or claim in accordance with this process.

13. External links

The Site may contain links to other websites, resources and/or advertisements. Uniquely Scotland cannot be held responsible for the content of any pages referenced by an external link that are not operated by Uniquely Scotland. Linked Sites may open in a new window. Uniquely Scotland does not control the Linked Sites and is not responsible for their contents, including any Linked Site through which you may have gained access to the Site or to which you may gain access from the Site. Your access and use of the Linked Sites is carried out solely at your own risk. We do not accept any liability in connection with any such linked Sites.

14. Force Majeure

The Company does not accept any liability for any loss, inconvenience or damage caused by war, threat of war, riot or civil commotion, terrorist or criminal activity, industrial disputes, natural disasters, fires, illness, weather conditions, road traffic conditions, temporary technical, electrical or mechanical breakdown, or events beyond the reasonable control of Uniquely Scotland.

15. Data protection

The information that you provide to us regarding you and members of your party will be held by us in confidence and not released to any third party saving those providing accommodation and/or activities/events for you and your party.

17. Travel Agents

Uniquely Scotland does not offer a commission rate although is happy to work with travel agents for specific tour requests or to design specific tour offerings for clients. Any commissions levied by travel agents to their clients should be claimed directly from clients before payment to Uniquely Scotland. Uniquely Scotland is not responsible for commissions levied direct to clients.
